Terms of Service

1. Introduction and acceptance

These Terms of Service (“Terms”) govern your use of the Manifest Markets website at manifestmarkets.online (the “Site”), and your purchase and use of our trading education, indicators, tools and community access (the “Products”).

By accessing the Site, creating an account, joining our community or buying a Product, you agree to these Terms, our Privacy Policy, our Refund Policy and our Risk Disclosure. If you do not agree, please do not use the Site or the Products.

2. Eligibility

You must be at least 18 years old, and legally able to enter into a binding agreement, to use the Site or buy our Products. You are responsible for making sure that your use of the Products is lawful where you live.

3. Education only, not financial advice

All Products and content are provided for educational and informational purposes only. Nothing we provide is financial, investment, tax or legal advice, or a recommendation to buy or sell any instrument. Trading carries a high level of risk and you can lose some or all of your capital. We do not guarantee profits or any particular result. You are solely responsible for your own trading decisions. Please read our Risk Disclosure in full.

4. Your account

To buy and access Products you may need to create an account. You agree to provide accurate information, keep your login details confidential and tell us promptly if you suspect unauthorised use. You are responsible for all activity under your account. Accounts are for one person only and may not be shared.

5. Purchases and payment

  • Prices are shown on the Site in ZAR and include applicable taxes.
  • Payment is taken at checkout through our payment providers. We do not store your full card details.
  • We may refuse or cancel an order, for example if we suspect fraud, an error in pricing, or a breach of these Terms, and will refund any amount paid for an order we cancel.
  • You are responsible for providing a correct email address so that you can receive access details.

6. Delivery and access

Products are digital. Course access is provided through your account once payment is confirmed. Indicators are delivered through a licence key or access link tied to your purchase.

You are responsible for having a compatible device, trading platform and internet connection.

7. Licence to use the Products

When you buy a Product, we grant you a limited, personal, non-exclusive, non-transferable licence to use it for your own personal trading and education. Indicator licences are limited to any device(s) / but only one account unless the product page says otherwise.

You agree that you will not:

  • Share, resell, rent, sublicense, give away or publicly post any Product, key code, access link or login
  • Copy, record, redistribute or republish course content, in whole or in part
  • Reverse engineer, decompile, modify or attempt to bypass any licence key or protection in an indicator
  • Use a Product to provide your own paid signals, courses or tools to others without our written permission

We may deactivate licence keys or access that are shared, resold or used in breach of these Terms, without refund.

8. Intellectual property

All content, including courses, videos, written material, indicators, code, logos, branding and the Site design, belongs to Manifest Markets or its licensors and is protected by copyright and other laws. Buying a Product gives you a licence to use it, not ownership of it.

9. Refunds

All sales are final except as set out in our Refund Policy. Please read it before you buy.

10. Community rules

If you join our Discord or other community spaces, you agree to be respectful and lawful. You may not harass others, spam, impersonate anyone, promote other products or services without permission, or share content that is unlawful or infringing. Opinions shared by the founder, team or members are personal views and not advice. We may remove content and remove or ban members at our discretion.

Our Products may run on or link to third-party platforms and services (for example TradingView / MetaTrader, payment providers and brokers). We do not control these services and are not responsible for their availability, content, terms or actions. Your use of them is at your own risk and subject to their terms.

12. Availability and changes to Products

We work to keep the Site and Products available, but we do not promise uninterrupted or error-free operation. We may update, change or discontinue Products or features, and we will try to give reasonable notice of significant changes.

13. Disclaimers

To the extent permitted by law, the Site and Products are provided “as is” and “as available”. We do not give any warranty that the Products will be profitable, accurate, uninterrupted, or suitable for your particular needs. Indicators may give delayed or incorrect signals, and past performance is not indicative of future results.

14. Limitation of liability

To the fullest extent permitted by law, Manifest Markets, its founder, team and affiliates will not be liable for any trading losses, loss of profit, loss of data or any indirect or consequential loss arising from your use of the Site or Products. Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you paid for the Product that gave rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, or limits any consumer rights you have under applicable law.

15. Suspension and termination

We may suspend or end your access to the Site, your account or any Product if you breach these Terms or misuse the Products. You may stop using the Site at any time. Sections that by their nature should continue, including intellectual property, disclaimers and limitation of liability, survive termination.

16. Privacy

We collect and use personal information as described in our Privacy Policy, in line with applicable data protection law, including South Africa’s Protection of Personal Information Act (POPIA).

17. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted here with a new “last updated” date. Your continued use of the Site or Products after changes means you accept the updated Terms. The Terms in force at the time of your purchase apply to that purchase.

18. Governing law and disputes

These Terms are governed by the laws of South Africa. If you have a complaint, please contact us first so we can try to resolve it. Any dispute that cannot be resolved will be subject to the jurisdiction of the courts of South Africa, without limiting any rights you have under mandatory consumer law.

19. General

These Terms, together with the policies linked above, are the entire agreement between you and Manifest Markets about the Site and Products. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms to anyone else.
